The Kassa Me Network (referred to as “Kassa Me,” “we,” “our,” or “us”), and this website is owned and operated by our parent company 360 BizVue, Inc.  We provide a service that enables a convenient way to transfer money between you and others who are enrolled directly with Kassa Me or enrolled with a financial institution that partners with Kassa Me (each, a “User”) using aliases, such as email addresses or mobile phone numbers. We refer to financial institutions that have partnered with Kassa Me as “Network Financial Institutions.” 

These terms of service (“Terms of Service”) were created for you to be fully aware of your respective legal rights and obligations while using our Kassa Me app or this website.  These Terms of Service are legally binding terms to govern your use of our Kassa Me app and this website. PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE SITE, BECAUSE THEY AFFECT YOUR LEGAL RIGHTS AND OBLIGATIONS

In order to use the payment functionality of the Kassa Me application, you must open a “Dwolla Platform” account provided by Dwolla, Inc. and you must accept the Dwolla Terms of Service and Privacy Policy.  Any funds held in the Dwolla account are held by Dwolla’s financial institution partners as set out in the Dwolla Terms of Service. You authorize Kassa Me to collect and share with Dwolla your personal information including full name, date of birth, social security number, physical address, email address and financial information, and you are responsible for the accuracy and completeness of that data. You understand that you will access and manage your Dwolla account through Kassa Me application, and Dwolla account notifications will be sent by Kassa Me, not Dwolla.  Kassa Me will provide customer support for your Dwolla account activity, and can be reached at www.KassaMe.com, support@kassame.com and/or 561-614-1815.

You expressly authorize Kassa Me service provider, Dwolla, Inc. to originate credit transfers to your financial institution account.  You authorize Kassa Me to collect and share with Dwolla your personal information including full name, email address, and financial information, and you are responsible for the accuracy and completeness of that data. Merchants will be charged a per-transaction fee and a next day funding fee of 1% when that option is selected during the Business Verified Customer process.

This is a general audience app and website for adults. We will assume (and by using this Site you represent that) you have the legal capacity to enter into the agreement set out in these Terms (i.e., that you are of sufficient age and mental capacity and are otherwise entitled to be legally bound in contract).

You represent that you are at least eighteen (18) years of age.

If you do not agree with any of these Terms, including the Privacy Policy incorporated herein, please do not use this Site. By using this Site you will be deemed to have irrevocably agreed to these Terms. Some areas of this Site may be subject to additional terms and conditions, which you should read carefully before making any use of those areas. ALL RIGHTS, OBLIGATIONS AND COVENANTS OF THE KASSA ME GROUP AND ANY KASSA ME CUSTOMER WITH RESPECT TO ANY KASSA ME PRODUCT OR SERVICE SHALL BE SUBJECT TO THE TERMS AND CONDITIONS OF A DEFINITIVE CUSTOMER SERVICE AGREEMENT EXECUTED AND DELIVERED BY THE PARTIES TO THAT AGREEMENT. IF THERE IS ANY CONFLICT BETWEEN THESE TERMS AND THE CUSTOMER SERVICE AGREEMENT, THE CUSTOMER SERVICE AGREEMENT WILL CONTROL.

IN NO EVENT WILL THE KASSA ME GROUP, ITS OWNERS, DIRECTORS, OFFICERS OR AGENTS BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING, BUT NOT LIMITED TO ANY DIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR OTHER INDIRECT DAMAGES ARISING OUT OF (I) THE USE OF OR INABILITY TO USE THE WEBSITE OR ITS CONTENT, (II) ANY CLAIM ATTRIBUTABLE TO ERRORS, OMISSIONS, OR OTHER INACCURACIES IN THE WEBSITE, THE PRODUCTS OR SERVICES DESCRIBED OR THE CONTENT, OR (III) ANY OTHER MATTER RELATING TO THE WEBSITE, THE PRODUCTS OR SERVICES DESCRIBED, OR THE CONTENT, EVEN IF THE KASSA ME GROUP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF YOU ARE DISSATISFIED WITH THE WEBSITE, THE CONTENT OR WITH THE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE WEBSITE. IN THOSE STATES WHERE THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES MAY NOT APPLY, ANY LIABILITY OF THE KASSA ME GROUP, ITS OWNERS, DIRECTORS, OFFICERS AND AGENTS LIABILITY IN THOSE STATES IS LIMITED AND WARRANTIES ARE EXCLUDED TO THE GREATEST EXTENT PERMITTED BY LAW, BUT SHALL, IN NO EVENT, EXCEED $100.00.
